TERMS & CONDITIONS
The terms and conditions set forth herein are the sole contract between Bill Fox All-Inclusive Vacations (hereinafter referred to as BFAIV), located at 21999 Van Buren Street, Grand Terrace, CA 92313, and the tour participant(s). BFAIV reserves the right to increase rates due to airline fuel surcharges or government imposed taxes. Payments for air passage and/or tour programs are accepted by BFAIV only with the understanding that the participants(s) has been made aware of, and agrees to, all conditions of this contract prior to sending BFAIV such payments.
CHANGES AND CANCELLATIONS
Should you wish to change any details of your booking (reservations), we will do our best to assist you. However, please understand that your right to a full or partial refund is limited. Changes and/or cancellations to your package will incur penalties ranging from a minimum of $100 per person to 100% of our entire package price. These penalties/fees that apply will vary depending on policies of the resorts, airlines, and tour companies used by BFAIV. Once travel has begun, no refund for unused or partially used services will be made. Neither BFAIV nor its tour companies are responsible for any changes made by the resort or scheduled/charter air carriers, which are beyond our control. This includes but is not limited to routing changes, aircraft changes, flight cancellations, changes to flight schedules, or resort amenities/offers. In no event shall BFAIV be held liable for consequential damages. Although overbooking is very rare they are the responsibility of the airlines and resort properties, not BFAIV or its associated tour companies. We reserve the right to substitute flight and hotel/resort accommodations and to make alterations in the itinerary, which do not constitute a major change, if necessary, due to circumstances beyond the control of BFAIV or its associated tour operators.
DOCUMENTATION
It is the sole responsibility of each passenger to research and obtain any needed documentation for his or her foreign destination trip. Passengers denied boarding or denied entry to their destination because of improper documentation will receive no refund.
INSURANCE
It is strongly recommended that you purchase Pre-Travel Cancellation Insurance at the time of deposit of your Caribbean or Mexico travel package. If you choose to decline coverage, we have your signature on the Credit Card Authorization Form declining coverage.
Bill Fox All-Inclusive Vacations Pre-Travel Cancel for Any Reason Insurance is available for a cost of $79.00-$139 per person depending on the cost of your booked package. This Insurance is non-refundable once purchased. Insurance cost is payable at time of deposit and cannot be added at a later time.
Pre-Travel Insurance: Covers full payments to Bill Fox All-Inclusive Vacations if you must cancel your trip prior to travel for ANY reason prior to your outbound flight departure.
Your refund will be made to the same credit card or form of payment used for final payment. Refunds typically take 4-6 weeks to process.
BFAIV will incur no liability in connection with Trip Cancellation Insurance. Any disputes regarding your Trip Cancellation Policy shall be directed towards the Insurance Carrier and not BFAIV. You hereby release BFAIV from any and all liability you may incur, and from any and all disputes you may have, in connection with performance of the terms if your Trip Cancellation Policy.
DISCLOSURE OF AGENCY AND WAIVER OF LIABILITY
BFAIV is acting as a mere agent for SUPPLIERS (identified on the accompanying documents) in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air ground transportation, hotel accommodations, meals, tours, cruises, insurance, etc.). BFAIV, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or connections, scheduling, or handling of baggage or other personal effects. BFAIV shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside BFAIV control. Traveler assumes complete and full responsibility for, and hereby releases BFAIV from, any duty of checking and verifying any and all passport, visa, vaccination,, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. However, we specifically recommend that U.S. (United States) Citizens traveling internationally do so with a valid U.S. Passport. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department, (202) 647-5225, or access the State Department’s on-line travel advisory service (www.state.gov/travelinformation/travelwarnings). For medical information, please call the u.S. Centers for disease Control (CDC) (404) 322-4559 or log on to www.cdc.gov/travel. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency. Traveler is advised to obtain appropriate insurance coverage against these risks; information is available through BFAIV regarding travel insurance. Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above and an agreement on his/her part to convey the contents hereto his/her travel companions or group members.
Final payment is due in our office no later than 50 days prior to departure. A $25 per person late fee will be assessed if final payment is not received by this date. This date will be plainly listed on your reservation confirmation. If we have not received final payment 40 days prior to travel, your vacation package will automatically be canceled and there will be no refund of your deposit.
